Gokin — Terms of Use

These terms are an agreement between you and Shapeweaver Solutions Inc. ("we"), of 404-6860 Royal Oak Avenue, Burnaby, British Columbia V5J 0G9, Canada, about your use of the Gokin app. By creating an account or using the app, you agree to them. Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.

Who can use Gokin

You must be at least 16 years old. You need an account to use the app, and the account is for you alone. You are responsible for keeping access to the email address you sign in with secure, since anyone who can read it can sign in as you.

Your health comes first

Gokin builds workouts and suggests exercises, sets and loads. It is not medical advice, and it does not know your health. Talk to a doctor before starting a new exercise program, especially if you have a medical condition, an injury, or are pregnant. Stop exercising and get help if you feel pain, dizziness, shortness of breath or discomfort. Use equipment properly and within your own limits — the loads the app suggests are starting points, and you decide what is safe for you to lift.

You take part in any exercise at your own risk. To the extent the law allows, we are not responsible for injury or harm that results from exercise you do while using the app.

The Gokin Subscription

The core of Gokin is free. The Gokin Subscription adds saved workouts, one-tap repeat, exercise library editing and your full history detail.

• Plans and billing. The subscription is sold monthly or yearly through the App Store or Google Play, at the price shown in the app before you confirm. Payment is charged to your App Store or Google Play account when you confirm the purchase.
• Automatic renewal. The subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the current period ends. Your store account is charged for the renewal within 24 hours before the period ends.
• Free trial. Where a free trial is offered, it is available once, to eligible new subscribers, and the store decides who is eligible. Unless you cancel at least 24 hours before the trial ends, the subscription begins and you are charged. If you buy a subscription during a trial, any unused part of the trial ends.
• Cancelling. Cancel at any time in your App Store or Google Play subscription settings, or from Settings → Gokin Subscription → Manage subscription in the app. You keep the subscription until the end of the period you have paid for. Deleting your Gokin account does not cancel the subscription — cancel it in the store first.
• Refunds. Apple and Google handle payments and refunds under their own policies. Ask them for a refund; we cannot issue one ourselves.
• Price changes. We may change the price of the subscription. The store tells you before a new price applies to you and, where the law or the store requires it, asks for your agreement first.
• What happens when it ends. Your saved workouts and your full history stay stored under your account. They are locked, not deleted, and open again if you subscribe again.

Metals, alloys, XP and levels

The Metals a workout finds, the alloys you forge, your XP and your Node levels are features of the app. They are not property, have no cash value, cannot be bought, sold or transferred, and cannot be exchanged for money or anything else.

Your data

Your training history is yours. You give us permission to store and process it only as needed to run the app for you — to keep your history, sync it between your devices and show it back to you — as described in the Privacy Policy. You can ask for a free copy of it, or delete it, at any time.

Using the app fairly

Please do not:

• copy, modify, reverse engineer or resell the app, or try to get at its source code, except where the law allows it;
• interfere with the app or the systems behind it, or try to get into another person's account or data;
• use the app to break the law, or use automated means to access it.

We may suspend or close an account that breaks these terms. Where we can, we will tell you why first.

What belongs to us

The app, its design, its exercise catalog, its names and its artwork belong to Shapeweaver Solutions Inc. or the people who license them to us. These terms give you a personal, non-exclusive, non-transferable right to use the app for your own training, and nothing more.

The app as it is

We work to keep Gokin running and accurate, but we provide it "as is" and "as available". We may change, add or remove features, and we cannot promise the app will always be available or free of errors. The core of a workout runs on your phone and keeps working without a connection.

To the extent the law allows, we are not liable for indirect or consequential losses, or for losses of data, profits or opportunity, and our total liability to you for any claim about the app is limited to the amount you paid us for the subscription in the 12 months before the claim. Nothing in these terms limits a right you have under consumer protection law that cannot be limited by agreement.

Ending this agreement

You can stop using Gokin and delete your account at any time from Settings. These terms end when your account is deleted, except the parts that by their nature continue, such as "Your health comes first", "What belongs to us" and "The app as it is".

The App Store and Google Play

If you downloaded Gokin from the App Store:

• These terms are between you and Shapeweaver Solutions Inc., not Apple. We, not Apple, are responsible for the app, its support and its content.
• Apple has no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claim about the app, including product liability, a failure to meet legal or regulatory requirements, consumer protection claims, and any claim that the app infringes someone else's intellectual property.
• You confirm that you are not located in a country subject to a United States embargo, and that you are not on a United States list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's Licensed Application End User License Agreement also applies, and where it conflicts with these terms for an App Store download, it governs.

If you downloaded Gokin from Google Play, Google Play's terms of service also apply to your download and purchases.

The law that applies

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute will be heard in the courts of British Columbia, unless the consumer law where you live gives you the right to bring it in your own courts.

Changes to these terms

If we change these terms, we will update this page and the date at the top. If a change materially affects you, we will email the address your account signs in with before it applies. Continuing to use Gokin after a change takes effect means you accept it.
